PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE ACCESSING OR USING THE 53ON APPLICATION AND ITS SERVICES, IN ORDER TO ENSURE THAT YOU UNDERSTAND EACH PROVISION.
Preliminary Provisions
This Terms of Use document (hereinafter, the “Terms of Use” or the “Terms”) governs access to and use by users (hereinafter, the “User” or the “Users”) of the mobile application, website, products, and services associated with the 53ON digital platform (hereinafter, collectively, the “Services” or the “53ON Application”).
By accessing, registering, or using the Services, the User declares that they have read, understood, and expressly and irrevocably accepted these Terms of Use, as well as the Privacy Notice and any other supplementary policies published by 53ON. If the User does not agree with the provisions herein, they must refrain from using the Services.
53ON may modify these Terms of Use at any time. Modifications will be communicated through their publication in the 53ON Application, on the website, or through other appropriate notification means (for example, email or in-app notifications). Continued use of the Services after such communications will be deemed tacit and binding acceptance of the modified Terms of Use.
Definitions
- 53ON: technology platform that facilitates the connection between Users who require technical, domestic, or other permitted services and the independent providers who offer them.
- 53ON Application or App: mobile application for iOS, Android, or other compatible systems, as well as any web version or digital interface made available by 53ON.
- Website: website or websites operated by 53ON related to the “53ON” brand.
- Client User: natural or legal person who uses the Application to request or hire services offered by providers through the platform.
- Provider User or Provider: natural or legal person who offers and provides services to Client Users independently, using 53ON as an intermediation channel.
- Account: individual profile created by a User (Client or Provider) in the 53ON Application, linked to access data and basic personal information.
- Order or Service Request: transaction through which a Client User requests a specific service via the Application, indicating details such as type of work, service address, and other relevant data.
- Content: texts, images, logos, trademarks, designs, interfaces, source code, photographs, videos, reviews, comments, or other elements available in the Application.
- Force Majeure or Act of God: event or circumstance that is unforeseeable or that, being foreseeable, cannot be avoided, and that totally or partially prevents the fulfillment of obligations (for example, natural disasters, armed conflicts, massive telecommunications failures, governmental measures, etc.).
1. Acceptance of the Terms
By creating an Account, clicking “Accept”, “Sign Up”, “Continue” or similar, or by effectively using the 53ON Application, the User agrees that they have read and understood these Terms of Use and the Privacy Notice. The User declares that they have sufficient legal capacity to contract under the legislation applicable to them.
If the User accesses on behalf of a company or entity, they represent that they have sufficient authority to bind such entity to these Terms of Use, assuming the obligations on its behalf.
2. Account Registration and User Responsibility
- To use certain features of the 53ON Application, it is necessary to register and create an Account, providing truthful, complete, and up-to-date personal data.
- The User agrees not to share their credentials (email, phone number, passwords, verification codes) with third parties and to maintain their confidentiality.
- The User is responsible for all activities carried out from their Account, including service requests, messages sent, data provided, and payment methods used.
- 53ON may suspend or cancel the User’s Account, in whole or in part, when it detects fraudulent use, violation of these Terms, breach of the law, or any behavior that may affect other users, providers, or the platform itself.
3. License of Use and Intellectual Property
53ON grants the User a limited, personal, revocable, non-exclusive, and non-transferable license to download, install, and use the Application solely for the purpose of accessing the Services in accordance with these Terms of Use.
All intellectual property rights over the Content of the 53ON Application (software, logos, designs, texts, images, code, databases, etc.) belong to 53ON or to third parties who have authorized its use. The User agrees not to reproduce, distribute, modify, decompile, perform reverse engineering, assign, license, or exploit the Content in any way, except with the express written authorization of 53ON or the corresponding rights holders.
4. Permitted and Prohibited Use
The 53ON Application must only be used to request, offer, or manage lawful services, in accordance with applicable law and these Terms of Use.
- It is prohibited to use the Application to carry out unlawful, defamatory, fraudulent, abusive, discriminatory, harassing acts, or acts that violate the rights of third parties.
- The User must not introduce content into the platform that is illegal, offensive, violent, sexually explicit, discriminatory, or contrary to good morals.
- The Application may not be used to send spam, unauthorized mass campaigns, or unsolicited automated messages.
- The User may not manipulate the platform through bots, scripts, unauthorized scraping techniques, or attempt to compromise its security.
5. Role of 53ON and Intermediation with Providers
53ON is a technology intermediation platform that facilitates contact between Client Users and independent Providers. Unless expressly stated otherwise in a specific case, 53ON does not directly provide the services contracted through the App; such services are provided by independent Providers.
- Providers are solely responsible for the quality, timeliness, safety, and performance of the services they offer to Client Users.
- 53ON does not guarantee the individual professional suitability of each Provider, although it may apply basic validation processes, data verification, or reputation records to improve the platform experience.
- The User acknowledges that any contractual relationship for the effective provision of services (for example, repairs, cleaning, maintenance, etc.) is established primarily between the Client User and the Provider.
- Nevertheless, 53ON may act as a channel for support, basic mediation, or assistance in case of claims, complaints, or incidents, without this implying that 53ON assumes direct responsibility for the results of the service.
6. Payments, Billing, and Refunds
- Charges for services requested through 53ON may be managed via external payment gateways or internal mechanisms of the platform.
- The User undertakes to provide valid payment methods and to have sufficient funds to cover the amounts of the services contracted, taxes, fees, and applicable charges.
- In case of payment disputes, chargebacks, or billing errors, the User must contact 53ON within a reasonable time to review the case.
- Refund, cancellation, or service modification policies may be consulted in the Application or on the website. These may vary depending on the type of service, timing of cancellation, and conditions agreed with the Provider.
7. Geolocation, Service Address, and Privacy
The use of geolocation and service addresses is governed in detail in the 53ON Privacy Notice. In general terms:
- The User may manually set an address for the provision of services or enable device geolocation to facilitate the search for nearby providers.
- The service address and, where applicable, the approximate location are shared only with the assigned Provider and with the technological third parties necessary for operation (for example, mapping services), all under security measures.
- The User may revoke geolocation permission from their device settings, although this may limit certain functionalities of the App.
8. Communications with the User
53ON may send communications related to the provision of the Services, such as order confirmations, status updates, security alerts, support messages, and other notices necessary for the operation of the platform.
Additionally, 53ON may send promotional communications, surveys, or information about new features, always in compliance with applicable regulations and offering mechanisms for the User to manage their preferences or opt out of such commercial communications.
9. Cookies and Other Technologies
The 53ON Application and its website may use cookies, device identifiers, web beacons, server logs, and similar technologies to understand platform usage, improve performance, and personalize the experience. The details of these technologies, their purpose, and the User’s options are explained in the Privacy Notice.
10. Limitation of Liability
- Use of the 53ON Application is at the User’s sole risk. The platform is provided “as is” and “as available”, without guarantees of uninterrupted or error-free operation.
- 53ON shall not be liable for direct, indirect, incidental, consequential, loss of profit, loss of data, or any other damages arising from the use or inability to use the Application or the services provided by Providers, except to the extent that such liability cannot be excluded under applicable law.
- The User is responsible for verifying the credentials, reputation, and suitability of the Provider, as well as taking reasonable safety precautions at the location where the service is provided.
- 53ON is not liable for damages, losses, or incidents arising from the actions of the Provider, its employees, or third parties, except in cases where direct liability of 53ON is legally determined.
11. Force Majeure
53ON shall not be liable for failure or delay in fulfilling its obligations when such is the result of Force Majeure or Acts of God, such as natural disasters, conflicts, widespread telecommunications failures, governmental restrictions, or other events beyond its reasonable control.
12. Modifications to the Services and to the Terms
53ON may, at any time, update, modify, suspend, or discontinue part or all of the Application’s functionalities, as well as adjust these Terms of Use to reflect legal, technical, or business changes.
Any significant modification will be notified to the User through the Application, the website, or by email. Continued use of the Services after such notification will imply acceptance of the new terms.
13. Termination of the Account
- The User may request the deactivation or deletion of their Account at any time, in accordance with the mechanisms available in the App or by contacting support.
- 53ON may suspend or cancel the User’s Account in case of breach of these Terms, misuse, fraud, potentially unlawful activities, or when required by law or a competent authority.
- Termination of the Account does not exempt the User from fulfilling outstanding obligations, such as payments, pending claims, or responsibilities arising from services already provided.
14. Governing Law and Jurisdiction
These Terms of Use shall be interpreted and applied in accordance with the laws of the country or region from which 53ON provides services to the User in each case. In the event of a dispute, and unless consumer protection laws establish otherwise, the parties submit to the jurisdiction of the competent courts of that jurisdiction.
